Casino loses fight against smoking ban
KRDO, Friday, October 03, 2008 at 10:18:11 AMIt was a blow to casinos in the small gaming town of Cripple Creek. On Thursday, Judge Jackson Peters ruled in favor of the state when it comes to the statewide smoking ban.
The Midnight Rose challenged the law after it was ticketed for breaking the law in June. It later claimed it was a cigar bar, which would have allowed smoking in the casino.
The Judge, in his ruling, says the legislature clearly defines what a cigar-tobacco bar is, writing, "It must be a watering hole operated primarily for the sale and service of alcohol beverage." He continued that while the Midnight Rose does sell and comp alcohol, its main source of revenue is gaming.

New discoveries: Upstairs, 2nd floor where the deli used to be is now much improved as Dynamite Dick's. We had meal coupons for dinner so we enjoyed the ribs. Nice place; waterfalls and great view of Bennett street and nice tables to sit at. Much improved from the old place and we noticed a lot of folks taking meals to go. Glad we found it.
Bar tops! My favorite game Power Keno I found in dimes at the bar tops and the drink service was fabulous. It also helped that I won but I have to say that I am glad I ventured upstairs to discover that they really classed up the place with a recent remodel. There were several keno games in various denominations at the bar along with a lot of nickel and penny machines.
Brass Ass upstairs-it appears that additional 3 Card and Black Jack tables are going in upstairs next Thurs to allow for more tables for players.
The main floor of Midnight Rose was hopping on Thurs night and lots of pay outs on dollar machines I noticed.
A great time at Midnight Rose and glad to see that business is a bit more steady.”
Author: CurmudgeonPosted: Friday, August 21, 2009“Having driven 50 miles specifically to sign up for the evening holdem tournament (a 45-minute sign-up window between 6:30 and 7:15pm which the casino's website said was strictly enforced), I was taken aback when the hostess told me curtly that the man doing the sign-ups was "over there", and more importantly, that unless I was already playing in a live poker game, I would have to wait until 7pm to sign-up. I didn't like the hostess's attitude (what is it about card rooms that makes casino employees forget they are in the hospitality industry?) but even more, I didn't like the idea that tournament sign-up was effectively limited to a 15-minute window. In Colorado, where everywhere is at least a half-hour from everywhere else, this struck me as willfully stupid, and it annoyed me so much I decided not to play there, ever. They lost out on their share of my entry fee as well as any rake they would have gotten from my limit holdem play had they been less surly, plus, any future card room revenue from me. There are other cardrooms in Cripple Creek, and I'm sure at least one treats players like guests rather than cattle.”
